Representative Transactions:

• Assisted our client, a major Canadian University, in a case involving delay claims totalling more than 13 million arising from a student housing project.
  
• Acting for the same University, we resolved a dispute with a contractor, and its surety (an Insurance Company), for the cost to complete the renovation to a central campus complex.
  
• Acted for the successful proponent for the first Design/ Build/Develop Agreement awarded by the BC Transportation Finance Authority, which involved design and construction of a major highway interchange in exchange for cash and land.
  
• Preparation of standard form construction contracts adapted from CCDC-2, 1994, adding numerous provisions for the benefit of the owner/developer, and in particular to favourably address the "payment certifier" and "holdback savings account" provisions of the Builders Lien Act, 1997 and to minimize delay claims and claims for extras at the end of the project.
  
• Representing a municipality in formulating a Public-Private Partnership for Multiple Surface Ice Rink Facility (with a focus on business advice to the Municipality, to formulate the RFP so as to elicit the most financially favourable proposal, and to present a workable financial model readily financable by the successful proponent).
  
• Advising our client, a major Canadian International Airport, with regards to approaches to bidding and tendering and with regard to construction related matters with respect to major additions and expansions.
  
• We also assist one of Canada's foremost universities in its construction-related matters such as avoiding and, if necessary, resolving claims for delay, change orders and the like.
  
• One of our members acted as the sole arbitrator in a $1 million construction dispute involving a municipality and a road building contractor.
  
• Represented a raw material supplier in a class action involving polybutylene plumbing systems.
  
• Represented a distributor of radiant ceiling heating panels in a class action that settled.
