Labour Law

Clark Wilson LLP represents employers in all manner of labour relations before both the Canada and the BC Labour Relations Boards. Our representation deals with issues such as certification and de-certification, successorship, common employer applications, injunctions, and unfair labour practice complaints.

Members of our practice group have experience representing employers in collective bargaining, administration of collective agreements, and grievance arbitration. We have also assisted employers in drafting and implementing employment policies consistent with the terms of their collective agreements.

Employment Law

We assist clients in a wide range of employment matters, including employment agreements and policies, employee confidentiality and non-competition issues (including enforcement by injunction, when necessary), and handling wrongful dismissal actions and severance issues. We also provide advice in the administration and regulation of benefit plans, including pension plans.

In conjunction with our Privacy Practice Group, we also have experience with matters involving Privacy legislation, including setting up policies and procedures for employers who handle employee personal information.

Our experience also includes representing professionals in disciplinary proceedings before their professional association or regulatory body.

In addition, through our Immigration Practice Group, we are able to assist with all manner of business immigration issues, from assistance in processing permanent and temporary business visas to advice and assistance in obtaining Canadian permanent resident status and citizenship.

Human Rights Law

We represent clients in appearing before the BC Human Rights Tribunal. Primarily, our clients are employers dealing with complaints from former or current employees, alleging workplace harassment or discrimination issues. Our assistance extends to prevention of human rights complaints such as providing pre-termination advice, conducting workplace investigations after such complaints, and in drafting and implementing workplace policies to avoid such complaints in the future.
