Construction Law, Strata Property Law. Representative Work Acting as co-counsel for owners and contractors in tendering disputes. Acting as co-counsel for the owner in multiparty litigation arising from delayed completion of institutional buildings, with accompanying building deficiency problems. Advising strata corporations with respect to raising sufficient funds for repairs, contracting with the building envelope consultant and remedial contractor, third party warranty requirements, handling builders lien claims, collecting funds from delinquent owners, obligations to disclose building deficiency problems to third parties and resolving outstanding warranty claims. Acting as counsel for strata corporations in multi party litigation and mediation arising from design and construction deficiencies. Advising strata corporations and owners of their respective rights, powers and duties under the Strata Property Act, including providing advice with respect to the drafting and interpretation of bylaws, as well as internal governance issues, insurance claims and employment matters. Acting for strata corporations in the Supreme Court of British Columbia and in mediation and arbitration proceedings. Profile Allyson Baker is an Associate in Clark Wilson LLP’s Litigation Department. In 1989, Allyson graduated from Queen’s University at Kingston with a Bachelor of Science (Honours) in Biochemistry. She received a Bachelor of Laws from the University of British Columbia in 1993. Allyson articled and then practiced with Clark Wilson for six years, working primarily in the areas of construction law, condominium law, commercial law, personal injury and insurance defence. She was called to the Ontario Bar in June 2000 and thereafter practiced with a litigation boutique firm in Toronto in the areas of commercial and employment law. In October 2001, Allyson returned to Vancouver and, until rejoining Clark Wilson in October 2003, practiced with a litigation boutique firm in Vancouver in the areas of construction, strata property, environmental and commercial law. She is the co-author of the Employment Law chapter in the Strata Property Practice Manual, Continuing Legal Education of British Columbia, to be published in the spring of 2008. In addition, Allyson has written and presented on Directors and Officers Liability Insurance issues and on Non-Profit Directors and Officers Liability. Allyson has traveled extensively, residing in eight different countries and several Canadian cities before settling down in Vancouver. Community Involvement Ms Baker has been a member of the Board of Directors of the Condominium Homeowners Association since September 2004 and a member of the Board of Directors of the Developmental Disabilities Association of Vancouver- Richmond since November 2004.
