Area of Practice

Banking and Commercial Real Estate with an emphasis on secured lending transactions.

Representative Work

Lender counsel in connection with a variety of loan transactions (i.e. operating loans, demand loans, construction loans, foreign exchange loans, documentary credits, etc.).

Representing lenders with respect to loan transactions involving a variety of structures (i.e. joint ventures, limited partnerships, offshore entities, trusts, nominee held assets, etc.).

Acting for borrowers and lenders in all types of loan transactions/credit facilities from simple mortgage transactions to complex corporate financing matters involving residential and commercial developments, hotels, resort properties (including ski resorts throughout North America), native lands, leasehold lands, shopping centres, office buildings, industrial properties, professional sports and entertainment organizations and the radio and telecommunications industry.

Extensive experience acting for lenders regarding NHA/CMHC financing, syndicated loan transactions and secured bond financings.

Providing advice to clients on all aspects of the Personal Property Security Act (British Columbia), Bank Act (Canada), Strata Property Act (British Columbia), Real Estate Act (British Columbia), Land Title Act (British Columbia) and other legislation relating to commercial lending and real estate matters.

Kevin MacDonald is a partner of the firm, the Chair of its Commercial Lending Practice Group, Chair of the Students Committee and a member of the Commercial Real Estate Practice Group.

Kevin has acted for various financial institutions, including most domestic banks, many foreign banks, several trust companies and life insurance companies, pension funds and a number of private lenders. He also acts on behalf of a number of real estate developers.

He obtained his Bachelor of Arts degree in History and English from Whittier College, Whittier, California in 1982, his Bachelor of Laws from the University of British Columbia in 1987, and was called to the Bar of British Columbia in 1988.
