  • Contract drafting and negotiations
  • Tender disputes
  • Delay, productivity and acceleration claims
  • Deficiency claims, including technical subject matters such as refractory linings, feller bunchers and other heavy machinery, piping, glazing, tiling, cement applications, processed wood, and building envelope related deficiencies
  • Surety bond negotiations and claims
  • Insurance coverage and defence
  • Assisting Partnerships BC and Government with dispute arising in public private partnership projects
  • Claims during construction
  • Lien claims
  • Assisting parties in understanding their rights under RFQ and RFP process
  • Professional negligence claims
  • Condominium disputes

Experience in complex multi-party construction claims and product liability claims.

Use of ADR processes (mediation and arbitration) for cost effective resolution of disputes.

Successful defence of subcontractor in a $30 Million product liability claim.

Profile

Samantha Ip is a partner in Clark Wilson LLP’s Litigation Department.

She obtained her Bachelor of Arts degree in 1991 and her Bachelor of Laws degree in 1994, both from the University of British Columbia.

Samantha has experience in the Supreme Court (trial by jury and by judge alone), the Court of Appeal, and Federal Court. She is frequently involved in the resolution of claims through alternative dispute resolution methods and has appeared as counsel before administrative tribunals.

Samantha is a regular speaker at construction conferences and seminars, and she is the editor for the Legal Framework and the CLE Annual Law Review for Construction Law.

In addition to English, Samantha speaks French, Cantonese and Mandarin.
