Allyson Baker's article Condo owners covered by human rights code has been published in the December 19, 2008 edition of The Lawyers Weekly.

Don Sihota has been quoted in Canadian Business Magazine on the topic of Business Succession Planning. In the December 22 edition – the Special Rich 100 Issue - Don is quoted in the article by Dean Jobb called "Rich 100: Inside Irving". Don's comments are in the third paragraph on the last page of the article.

The December 2 - 8 edition of Business in Vancouver quotes Gwendoline Allison of our Labour & Employment group on company policies concerning employees' PDA use. The article, titled BlackBerrys becoming an issue for employers, appears in the "Legal Matters" section.

In addition to quoting Gwendoline, Business in Vancouver also cites her September 2008 Work Place Post article, The Blackberry Dilemma: Paying for the 24/7 Work Culture. That article has also been republished in Canadian Employment Law Today.




November, 2008

An article by Neil Melliship, with substantial assistance from articling student Seva Batkin, was published in the November edition of Internet & E-Commerce Law in Canada. The article is titled A Guide To E-Commerce Best Practices, and came out of a presentation Neil gave at a recent conference on the same topic.

The November 25-December 1 edition of Business in Vancouver quotes Shauna Towriss of our Insolvency & Restructuring group. The article is titled Time key for distressed acquisitions: experts and discusses how lawyers and insolvency professionals can help financially distressed companies with restructuring or selling their business. The article also references Shauna's September 2008 Business Matters article on the same topic.

Aaron Singer offers some tips on "How to Dissolve a Business Partnership" in the November issue of BC Business.

Kyle Wilson is quoted in the October/November issue of the Canadian Bar Association's National magazine. The article, titled "The phantom purchaser", discusses changes to the federal Proceeds of Crime (Money Laundering) and Terrorist Financing Act that place stricter regulations on real estate transactions.

Bernard Pinsky's article "Securities regulation: how much is too much?" has been published in the November 7, 2008 edition of The Lawyers Weekly. The article discusses securities regulations in light of the current liquidity crisis. Bernard is Chair of our Corporate Finance / Securities practice group.




October, 2008

September, 2008

Neil Melliship and Jeffrey Vicq of our Technology & Intellectual Property Group were featured in various media coverage over the news that Vancouver's Organizing Committee for the 2010 Winter Games (VANOC) had applied for trademark on lines of the Canadian national anthem. Neil was first quoted in a September 24 Canadian Press story, which was republished by both CTV and CBC. After publishing a post on the topic on the group's Trademark Blog, Neil was then interviewed by The Province and CBC Radio-Canada, while Jeffrey was interviewed for Global TV's National Newscast, and by Calgary's CHQR Radio.

Shauna Towriss' article Slowing economy presents opportunities and challenges, which discusses buying and selling financially distressed businesses, and Pratibha Sharma's article discussing The proposed Canada Not-for-profit Corporations Act were both republished on the Bar-eX website. The articles originally appeared in the September edition of our Corporate & Commercial Law group's Business Matters newsletter.

Elaine Adair was quoted in Thompson's World Insurance News in an article regarding secondary market liability of D&O's. The interview was prompted by Elaine's July 14th Insurance Bulletin, Secondary Market Civil Liability Comes to BC.

Bernard Pinsky was quoted substantially in The Bottom Line in "The sinister sway of soft whispers", an article on the U.S. Securities and Exchange Commission's recent crackdown on the spread of false information.

Conrad Nest was quoted in the September 9-15 edition of Business in Vancouver, in the article New securities commission regulations gunning for OTCBB stock swindlers based in British Columbia. Conrad is a member of our Corporate Finance / Securities practice group.

Don Sihota's article Secure the Purchase Price was published in the September edition of Canadian Funeral News. The article discusses the issue of pricing when selling a business. Don speaks and writes regularly on the subject, and has been requested to submit semi-regular articles to the magazine.

Kyle Wilson was quoted in the September 5, 2008 edition of Business Edge. The article, titled New money laundering rules target developers, discusses Canada's Proceeds of Crime (Money Laundering) and Terrorist Financing Act, and how the new legislation will impact real estate developers. July, 2008

The July 27th "Condo Smarts" column published in The Province newspaper quotes Allyson Baker on the importance of written agreements. The article, titled Get it in writing - no exceptions!, is part of a weekly series by Tony Gioventu, executive director of the Condominium Homeowner's Association (CHOA). Allyson is an Associate with our Strata Property practice group.

Nicole Byres' article BC Court of Appeal confirms Employment Standards Branch has exclusive jurisdiction for employee overtime claims was republished twice in July. Originally published in CW's June 2008 Work Place Post newsletter, Nicole's article was picked up by both HRinfodesk (July 21 edition) and Canadian Employment Law Today (July 25 edition).

Satinder Sidhu's article, Blackouts spark debate of all risks policies, was republished in the July 2008 edition of the Canadian Insurance Law Reporter. Satinder discusses the recent Ontario Court of Appeal decision in Caneast Foods Limited v. Lombard General Insurance Company of Canada, an indemnity case resulting from a 2003 electrical blackout. The article was originally published in the July 4 issue of CW's Insurance Bulletin.

Brock Smith was quoted by ITWorld Canada, in a July 17th article titled Vancouver tech firm aims to speed up legal system. The article discusses a new document management system launched by Sierra Systems that aims to streamline case files for judges and court staff. Brock is a partner with our Technology & Intellectual Property practice group.

A July 16th post written by Larry Munn on the Canadian Trademark Blog was noted by the popular Canadian law professor and blogger Michael Geist. Larry's post, Damages for Counterfeit Goods - Another Significant Award, reported on a recent decision in the British Columbia Supreme Court awarding damages for trademark and copyright infringement. The Canadian Trademark Blog is authored by our Technology and Intellectual Property practice group.

Brock Johnston, co-chair of our Public-Private Partnerships practice group, is quoted extensively in the July 2008 edition of BC Business, on the topic of P3s. The article, titled Roundtable: All Together Now, is the result of Brock's participation in a panel for BC Business in May, along with Partnerships BC CEO Larry Blain, and Sauder School of Business Professor Thomas Ross.

A video segment on the ILS Learning Corporation's website features Neo Tuytel discussing the impact of British Columbia's leaky condo crisis on the insurance industry. The video was shot in May at the Credit Union Insurance Services Association (CUISA) conference in Kelowna, where Neo was a presenter, and can be viewed at ilscorp.ca under ILSTV. Neo Tuytel was quoted in the June 3-9, 2008 edition of Business in Vancouver. The article, titled Judge sides with wine collectors after flood damage, discusses a recent decision in the BC Supreme Court. Tristin Lee was profiled in The Korea Daily News, a publication popular in Vancouver's Korean community. The article discussed Tristin's background and the path she has followed to become a lawyer with Clark Wilson.

Brock Johnston was quoted in an article in the National Post titled The P3 Boom. The article appeared on May 14th as a special report in the newspaper's Legal Post section. Brock is co-chair of our Public Private Partnerships practice group.

Jonathan Hodes of our Insurance practice group was quoted in an article on the Canadian Underwriter website titled Bill 22 in B.C. may require insurers to pay all bodily injury health care costs. Nigel Kent's article Insurance Bad Faith Litigation: Recent Developments and Interesting Issues Arising from the Supreme Court of Canada Decisions in Whiten and Fidler was published in the April 2008 issue of The Advocates' Quarterly. The full issue is available electronically, in pdf format, from the Canada Law Book website. The article begins on page 133. Nigel is chair or our Insurance Law practice group.

Nicole Byres was quoted in the April 2008 edition of Lexpert, in the article The Narrowing Lifestyle Gap by Kevin Marron. The article looks at how perceptions of work/life balance may influence lawyers' decisions in taking on either in-house or private practice positions.

Nicole Byres' article Retirement agreements: the next frontier in employment contracts? was republished in the April 20 edition of Bar-Ex. The article originally appeared in The Lawyers' Weekly on February 29.

Karen Monteith's recent post on the Canadian Trademark Blog about CIRA's new .CA WHOIS Policy was noted by Michael Geist, a popular Canadian law blogger. Dr. Geist is also the Canada Research Chair of Internet and E-commerce Law at the University of Ottawa. The Canadian Trademark Blog is authored jointly by our Technology and Intellectual Property practice group.

Brock Johnston, co-chair of our Public Private Partnerships group, was on CBC Radio on April 17. He was a guest on Rick Cluff's Early Edition, discussing how well-designed P3s can provide value for money while serving the public interest. Brock will also be speaking about P3s at the Partnering for Public Infrastructure conference, to be held in Toronto in May.

Don Sihota's article, Passing the Baton, was published in the latest issue of Alberta Oil (Volume 4, Number 1). Don's article offers a few lessons for succession planning in family run businesses. Alberta Oil is a high end magazine for Alberta and British Columbia businesses in the oil industry and has a wide circulation.

Bonnie Elster talks about our in-house training program in the article Continuing Professional Development: a look at three in-house approaches. The article appears in the March 2008 edition of the Law Society of British Columbia's Benchers' Bulletin.

Don Sihota was interviewed for the article Sell your business, which appeared in the March 2008 edition of Make It Business. Don was one of three experts assembled to answer questions about considerations in selling a business.

The article, which discusses "mandatory warranties" and the "2-5-10" reference in the Homeowner Protection Act, was originally published in the July 2007 issue of Legal Framework. It also appeared as the August 3, 2007 Feature Article on BCRELinks.com.

The February 2008 edition of Lexpert quotes Brock Johnston in the article The Land of the Rising P3. The article discusses the growth of Public-Private Partnerships throughout Canada, with Brock's comments providing a perspective on the process in BC.

Neo Tuytel was quoted extensively in the article CGL policies not designed with construction in mind, which was published February 28 on the Canadian Underwriter website. Neo was speaking at the Canadian Defence Lawyers' 4th Annual Insurance Symposium in Toronto.

The November 2, 2007 edition of The Lawyers Weekly features an article by Hannelie Stockenstrom, chair of our Construction group. Tony Fogarassy's paper, The Alaska Boundary Dispute: History and International Law was cited in an article published in the October 2007 edition of Oilweek Magazine. The article, titled Polar politics, discusses international disputes over sovereignty in the arctic, and the affect on oil and gas exploration there.




September, 2007

Once again our Securities Group has placed high on the PIPEs Scorecard, moving up to 7th in North America ranked by the number of placements advised as Issuer's Legal Counsel. Clark Wilson is the only Canadian law firm to make the list. The PIPEs Scorecard is a feature of the PIPEs Report, which provides news, information and analysis of private investments in public equity.

James Speakman's article, Real Estate Outlooks Changing Quickly, was picked up by Commercial Real Estate News on September 21.

In the September 2007 issue of Alberta Venure, Don Sihota is quoted extensively in the article Beating the rush to the exits. Citing a 2006 survey that found a large number of Canadian entrepreneurs plan to retire in the next few years, the article discusses the importance of developing a business succession strategy. Don is a partner with Clark Wilson's Business Law Department.

In the Thompson's World Insurance News article Black verdict could lead to d&o payout (September 10, 2007), Nigel Kent talks about D&O insurance coverage and how it may apply when 'negligent directors' are held accountable for the fraudulent activities of other directors and executives.

Tony Fogarassy's article Energy Security: U.S. has a role in mind for Canada and Mexico was published in the August 7th edition of The Vancouver Sun. The article focussed on recent U.S. efforts to create energy policy, which in large measure relies on Canada's and Mexico's extraction of natural resources and generation of electricity for the U.S. market, to reduce its dependency (President Bush says, addiction) on overseas energy supplies. Tony is a member of our Energy & Natural Resources Group.

Peter Tolensky was quoted in an August 7-13, 2007 Business in Vancouver article entitled Government reviewing changes to real estate contract language. The article discusses possible changes to construction contracts that may be coming as a result of the lawsuits surrounding Coquitlam's Riverbend development. Peter is a partner with Clark Wilson's Commercial Real Estate Group, and chair of the Canadian Bar Association's real estate subsection.

Interviews with Neil Melliship and Larry Munn were broadcast on the noon news hours of each station. Neil Melliship and Larry Munn are co-authors of the Canadian Trademark Blog.

Allyson Baker's article Failing to disclose and the impact on insurance coverage appeared in the March 2007 issue of CondoBusiness magazine. Bill Ruskin was quoted in a Business in Vancouver article on income trusts. Ruskin compared the tax implications for various corporate structures within and outside of income trusts, and issues that should be considered when converting from one type of structure to another. The article was published in the Dec. 12-18 edition of the newspaper.

Ross Tunnicliffe was widely quoted in a Business in Vancouver feature on Philanthropy.
