Class Actions

Class Actions became available in British Columbia in 1995, with the passing of the BC Class Proceedings Act. On the very first day this legislation was enacted, Clark Wilson became involved in defending a class action lawsuit launched against one of our clients. Since that time, our lawyers have developed a strong practice and a high level of expertise in this area.

Our Class Action practitioners have represented a wide range of clients in a variety of cases, including:

  • product liability claims in various industry sectors, including medical products, pharmaceuticals, food products and construction materials;
  • claims alleging price-fixing and anti-competitive practices under the Competition Act;
  • claims against financial services providers involving “vanishing premiums” and alleged collection of criminal rates of interest;
  • consumer complaints concerning auto salvage deductibles and beverage container refunds; and
  • litigation following the collapse of Bre-X Minerals.
