Clark Wilson has a broad range of experience working on environmental issues, including providing advice regarding regulations, negotiating with regulatory authorities, and defending and advancing environmental claims. Examples of our work include:

• assisting landowners and developers in procuring regulatory approvals and negotiating development agreements related to a broad range of environmental concerns, including water quality, storm drainage and related infrastructure issues, protection of sensitive lands, the application and variance of riparian regulations, green building standards, contaminated site regulation compliance, and the like, with local governments, the Department of Fisheries and Oceans, Ministry of Environment and others
• representing industrial clients, and other property owners, in connection with the terms of remediation, and claims related to the allocation of responsibility for the remediation of contaminated sites
• litigating the application of environmental exclusions in insurance policies
• representing major industrial clients, purchasers and others in transactions relating to bulk oil facilities, and other significantly contaminated lands
• defending permit appeals regarding the human health and environmental implications of discharges, including the defence of associated applications (permit suspension pending appeal, etc)
• advising regarding, and, as appropriate, litigating, the validity and application of environmental laws and bylaws
• acting on an environmental assessment review
• conducting environmental compliance reviews for a major industrial client
• providing input regarding changes to environmental legislation, regulations and policies
• advising environmental consultants regarding contract issues, environmental advice and claims defence
• advising directors and officers regarding environmental compliance and liability
