Estate & Trust Litigation is comprised of many areas of law and includes a number of disputes which can arise during the administration of an estate or trust. Some examples of this are when:
- A child or spouse of a deceased person believes that they should have a larger share of the estate than what is provided in the Will.
- Family members believe that the Will does not reflect the true wishes of the deceased.
- Beneficiaries wish to challenge the amounts claimed in an accounting of an estate or trust, or may wish to compel a more complete accounting.
- Beneficiaries wish to have the executor or trustee removed and replaced.
- The wording of the Will is unclear and directions from the Court have to be sought.
These types of situations can sometimes be resolved by negotiation or mediation. Sometimes it is necessary to seek the assistance of the courts. We can help in any of these circumstances.
