Personal Injury

We advise members of the public on issues relating to personal injury, including slips and falls, motor vehicle accidents and medical malpractice. Our focus is on serious personal injury, including paralysis and brain damage, however our group provides advice and service for the entire range of injuries in addition to handling all aspects of litigation.

We actively monitor our clients' rehabilitation and ensure that expertise is provided in all fields necessary to properly assess a claim. This includes neuropsychological assessments, vocational assessments, physical capacity evaluations, economic assessments of income loss and rehabilitation consulting. We have access to and experience with a broad range of experts, including architects, economists, accountants, rehabilitation consultants, medical experts and engineers.

Broken Jaw with Facial Disfigurement: Vaillancourt v. Molnar, September 10, 2001 (BCSC Vancouver Registry No. B991724) – Jury awarded Plaintiff $839,000, reduced on Appeal.

Obstetrical Medical Malpractice: Chong v. Royal Columbian Hospital, unreported, October 2, 1996 (B.C.S.C. Vancouver Registery No. C953391) – Approval of settlement at $2.5 million.

Brain Injury: O'Brien v. Anderson, unreported, March 1, 1999 (B.C.S.C. Vancouver Registery No. B962620) – Plaintiff was awarded $1.5 million.

Brain Injury: Nicholls v. Miller, unreported, January 28, 1991 (B.C.S.C. Vancouver Registery No. B892628) – Plaintiff was awarded $1.8 million.

Leg Amputation: Gilmore v. Board of School Trustees of School District No. 38 (Richmond), unreported, December 28, 1988 (B.C.S.C. Vancouver Registery No. B880794) - Plaintiff was awarded $300,000.

Knee Injury: O'Shaughnessy v. Alvarez and Newman v. Piercey, unreported, December 28, 1988 (B.C.S.C. Vancouver Registery No. B904069 & B921866) – Plaintiff was awarded $146,000.

Soft tissue injury to neck. – arthritis triggered by motor vehicle accident: Rogers v. Rekow, unreported, April 17, 1997 (B.C.S.C. Vancouver Registery No. B950090) & Plaintiff was awarded $124,000.

Wrongful death action. Settlement of $1.2 million was negotiated prior to trial.

Bad faith action against the Insurance Corporation of British Columbia. Settlement of $1.2 million was negotiated prior to trial.

Mild brain injury action. Settlement of $500,000 was negotiated during trial.
