Clark Wilson’s Banking, Insolvency & Restructuring and Fraud & Asset Recovery chair and partner Christopher Ramsay and associate Simon Wu’s article was recently published in LexisNexis Canada’s National Creditor/Debtor Review newsletter. In their piece, “Navigating Cross-Border Insolvency in the Digital Age: Insights from Atom Holdings” Chris and Simon examine two recent British Columbia decisions (Atom Holdings (Re), 2024 BCSC 1397 and Su v. Atom Holdings, 2025 BCCA 199) that offer important lessons on how courts are adapting cross-border insolvency frameworks to address the realities of cryptocurrency and digital asset recovery.

They highlight the innovative use of the Cross-Border Insolvency provisions under the Bankruptcy and Insolvency Act (R.S.C., 1985, c. B-3), including the first time a Canadian court has used section 272 to grant an Anton Piller–style order.
