Disputes can bring business to a grinding halt, especially in the construction world. Dan understands this well, making him a strong advocate for his clients. Dan resolves issues as efficiently as possible through negotiation, mediation or arbitration. Having appeared at all levels of court in British Columbia, Dan is well equipped to advance his clients’ interests and claims through litigation when necessary.

As part of his practice Dan routinely advises and assists his clients on construction matters, including builders lien matters, defect and negligence claims, and delay claims. Dan appreciates the importance of reputation and relationships in business. With this in mind, Dan considers the long-term impact on his clients’ business when he approaches disputes and potential resolutions. Dan also gives presentations to industry stakeholders on construction-related matters, including builders liens.

Dan has been an active member of the Canadian Bar Association of BC during his career, and he currently serves on the organization’s board of directors as the Young Lawyers Representative for British Columbia. In his various roles with CBABC, Dan has given presentations to students at British Columbia’s law schools on achieving success in the early stages of their careers.

Prosecution of multi-day trial to recover subcontractor’s unpaid accounts
  • Trial counsel for plaintiff-subcontractor in action for recovery of unpaid invoices. After a multi-day trial, obtained judgement in favour of the plaintiff for the full amount of its unpaid invoices, successfully defended against the defendant’s counterclaim for negligence, and obtained an order for double costs against the defendant: TNT Industries Ltd. v K5 Contracting Ltd., 2018 BCSC 592
Prosecution of lien claims
  • Counsel for trade contractors in various claims for unpaid fees and extras, obtaining full payment of lien claims.
Defence of lien claims
  • Counsel for developers and general contractors in defending against lien actions.
Dismissal of Action for Want of Prosecution
  • Successfully obtained judgement to dismiss an Action for want of prosecution (delay). The plaintiff had sought CAD$13 million+ in damages from the defendant: unreported decision.
  • Successfully obtained judgement to dismiss an Action for want of prosecution in a builders lien and breach of contract claim: unreported decision.
Summary judgement in case of investment fraud
  • Successfully obtained summary judgement for investor-plaintiff for return of significant investment funds: unreported decision.
  • Acted as appellant counsel and successfully defended the defendants’ appeal of the order: unreported decision.
Obtained injunctive relief for order for possession and recovery of property
  • Recovery of $250,000+ of culturally significant artwork that was wrongfully detailed from plaintiff-artist.
